Terms of Use

1. Scope and acceptance

These Terms apply to the full Atlas platform, including residences, lifestyle tools, services, messaging, request forms, events, directory pages, and payment-enabled workflows. By using Atlas, you accept these Terms.

2. Atlas's role

Atlas provides software, digital discovery, communications tools, workflow support, moderation, and platform administration. Atlas does not take title to properties, perform third-party work, supervise contractors, organize third-party events, or guarantee third-party goods, services, availability, pricing, safety, or outcomes merely because they appear on the Platform.

3. Eligibility and accounts

You must have legal capacity to form a binding agreement and provide accurate information. If you act for a business or organization, you confirm that you have authority to bind that entity. You are responsible for activity carried out through your account until Atlas has been notified of unauthorized use and had a reasonable opportunity to respond.

4. Electronic records and consent

Creating an account, clicking acceptance boxes, submitting forms, applying, requesting, paying, booking, or otherwise confirming electronically may constitute valid acceptance and record creation to the extent permitted by applicable law. Atlas may store electronic records for operational, security, evidentiary, legal, and compliance purposes.

5. No agency, brokerage, or professional advice

Your use of Atlas does not create an agency, brokerage, employment, fiduciary, partnership, landlord-tenant, or principal-contractor relationship with Atlas. Atlas does not provide legal, financial, tax, engineering, construction, safety, or investment advice through the Platform.

6. Listings, residences, and applications

Atlas may host residence listings, inquiries, applications, availability information, document workflows, and related features. Unless Atlas expressly says otherwise in writing, Atlas does not own, lease, manage, inspect, broker, sell, or guarantee listed properties and does not make tenancy decisions for third parties. Listing owners and partners remain responsible for authority, accuracy, approvals, rejections, lease terms, possession, condition, and compliance.

7. Services, contractors, vendors, and requests

Atlas may provide service directories, request-routing, messaging, ratings, and job history tools. Unless Atlas expressly says otherwise in writing, Atlas does not perform the work, employ contractors, supervise the means or methods of work, or guarantee licensing, insurance, quality, workmanship, pricing, timing, or safety. Customers and service partners remain responsible for their direct arrangements, scope, permits, labour, insurance, taxes, and legal compliance.

8. Events, promotions, and third-party offers

Atlas may host or promote event pages, reservations, advertisements, and third-party offers. Unless Atlas expressly says otherwise for a specific item in writing, Atlas is not the organizer, venue operator, promoter, seller, or merchant of record and does not guarantee event legality, safety, attendance, timing, refunds, or organizer performance.

9. User content and conduct

You are solely responsible for listings, profiles, reviews, service descriptions, event details, messages, photos, pricing, and all other content you submit. You must not submit false, misleading, unlawful, abusive, or infringing material, impersonate others, spread malware, or use the Platform in a way that implies an endorsement or guarantee from Atlas where none exists. Atlas may remove content, reject submissions, or suspend accounts where reasonably necessary.

10. Payments and fees

Atlas may charge platform fees for visibility, subscriptions, promotions, premium tools, or other platform features. Unless Atlas expressly says otherwise, fees are payable when shown, may be non-refundable except where required by law, and non-payment may limit access. Where Atlas facilitates a payment between users, Atlas acts as a platform facilitator unless Atlas expressly states that it is the merchant of record or direct payee.

11. Ratings, badges, and trust signals

Atlas may display ratings, badges, featured placement, ranking, or other visibility signals. These are informational only and do not amount to a guarantee, certification, representation, or warranty by Atlas.

12. Privacy

Atlas processes personal information in accordance with the Atlas Privacy Policy and applicable law, including applicable Bahamas data protection requirements.

13. Disclaimers

To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind. Atlas disclaims implied warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and quiet enjoyment, except where such disclaimers are prohibited by law.

14. Limitation of liability

To the maximum extent permitted by law, Atlas and its affiliates, officers, employees, contractors, licensors, and agents are not liable for indirect, incidental, consequential, exemplary, or punitive losses arising from third-party conduct, listings, services, events, offers, platform downtime, or disputes between users. Atlas's aggregate liability for any claim relating to the Platform shall not exceed the greater of the amount paid by you to Atlas in the twelve months before the event giving rise to the claim, or BSD 100. Nothing here excludes liability that cannot legally be excluded.

15. Indemnity

You agree to indemnify and hold Atlas and its affiliates, officers, employees, contractors, and agents harmless from claims, losses, liabilities, costs, and expenses arising from your breach of these Terms, your content, your use of the Platform, your dealings with other users, or your violation of law or third-party rights.

16. Governing law

These Terms are governed by the laws of the Commonwealth of The Bahamas. Unless applicable law requires otherwise, disputes are subject to the exclusive jurisdiction of the courts of the Commonwealth of The Bahamas.
